Goobit seeks reconsideration and appeals Finansinspektionen's MiCA decision

2026-07-23 20:30:00

As part of the process, Goobit has, in a short space of time, strengthened and streamlined its independent control functions, including new full-time roles within Compliance, MLRO and Risk Management, as well as updated internal procedures for governance and regulatory compliance. – "It feels really good to have a team that can bring a matter of this nature to a conclusion in such a short time. It is a clear testament to the expertise and commitment that exists within the organization," says Christian Ander, CEO of Goobit Group AB.

Goobit Group AB (publ) announces that its wholly owned subsidiary Goobit AB has today filed an appeal with Finansinspektionen against the authority's decision of 2 July 2026 to reject the company's application for authorization as a crypto-asset service provider under MiCA.

Goobit primarily requests that Finansinspektionen amend its decision and grant the company authorization.
Should Finansinspektionen not amend the decision, Goobit secondarily requests that the Administrative Court in Stockholm (Förvaltningsrätten i Stockholm) amend the decision and grant the company authorization.
As a third alternative, Goobit requests that the Administrative Court set aside the decision and refer the matter back to Finansinspektionen for a full and renewed review.

The appeal is based, among other things, on Goobit AB's view that Finansinspektionen did not carry out a sufficiently individual and proportionate assessment of the company's operations, organization and overall control environment.
Goobit AB further considers that the rejection decision does not rest on the objective and demonstrable grounds required under MiCA. In the appeal, the company also notes that Goobit AB was given limited time to comment on questions of material significance, which were subsequently used as grounds for the rejection decision — a matter the company addresses with reference to the communication obligation under the Swedish Administrative Procedure Act (förvaltningslagen).

– "As we have already communicated, this is not the outcome we had hoped for following the extensive work invested in our MiCA application. At the same time, we consider that the decision does not provide a fair picture of Goobit's actual operations, overall control environment, or the work that has been built and developed over many years," says Christian Ander, CEO of Goobit Group AB.

– "Goobit has operated under Finansinspektionen's supervision since 2013 and has built up significant experience in areas including customer due diligence, transaction monitoring and the work against financial crime. We respect Finansinspektionen's mandate, but we do not share the authority's assessment on several key points. Our view is that the application needs to be reconsidered based on Goobit's actual operations and an individual and proportionate assessment," Christian Ander continues.

Finansinspektionen has confirmed in writing that Goobit AB, under the Swedish transitional provisions, may continue to provide the relevant services while the appeal is being reviewed.

Goobit will keep the market informed of material progress in the matter.
